Welcome to the bioLytical Platform, also known as bioLytical University, provided by bioLytical Laboratories Inc. (“bioLytical,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our online training and certification platform, which is hosted on Thinkific (the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Eligibility
You must be at least 16 years old or the age of majority in your jurisdiction to use the Platform.
By registering, you confirm that the information you provide is accurate, complete, and kept up to date.
2. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials.
You agree to notify us immediately if you suspect unauthorized use of your account.
bioLytical is not liable for any loss or damage resulting from your failure to safeguard your account.
3. Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
Share, resell, or misuse your account credentials.
Copy, distribute, or modify course content without prior written consent.
Upload or transmit harmful content, including viruses, malware, or offensive material.
Interfere with or disrupt the Platform’s functionality.
4. Training and Certification
Courses and certifications provided through the Platform are designed to train users on the safe and correct use of bioLytical products.
Successful completion of a course or certification does not grant a license to sell or distribute bioLytical products unless separately authorized by bioLytical.
bioLytical reserves the right to revoke or deny certifications if fraudulent activity, misconduct, or misuse of the Platform is identified.
5. Intellectual Property
All content on the Platform, including text, videos, graphics, logos, course materials, and trademarks, is owned or licensed by bioLytical and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access the content solely for personal training and certification purposes.
Any unauthorized reproduction, distribution, or commercial use is strictly prohibited.
6. Payments and Refunds (if applicable)
If certain courses require payment, fees will be displayed before purchase.
All payments are processed securely through Thinkific’s payment system.
Refunds, if applicable, will follow the refund policy outlined at the time of purchase.
7. Third-Party Services
The Platform is hosted on Thinkific. Your use of the Platform is also subject to Thinkific’s terms of service and privacy policy.
We may provide links to third-party resources; bioLytical is not responsible for their content or practices.
8. Disclaimers
The Platform and its content are provided “as is” and “as available” without warranties of any kind.
bioLytical does not guarantee that the Platform will be error-free, uninterrupted, or suitable for your specific needs.
Training and certification content does not replace official medical advice or professional training outside the scope of bioLytical products.
9. Limitation of Liability
To the maximum extent permitted by law:
bioLytical is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.
Our total liability for any claims relating to the Platform will not exceed the fees (if any) paid by you to access the Platform.
10. Termination
We may suspend or terminate your access to the Platform at any time, without notice, if you violate these Terms or engage in misuse of the Platform.
11. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Platform after updates means you accept the revised Terms.
